Description:

2012 Legal Update – Stephen Hirschfeld, Esq.

There were many significant legal developments in 2011. Even more is expected in 2012. This session will provide practical insight on the most important legal issues including:

How the Supreme Court’s rulings on class actions and retaliation will affect you

Continued expansion of disability discrimination and the ADA’s reach

New developments in sexual harassment law

Overview of key court decisions and verdicts- lessons to be learned

Discussion of the most important new state laws

Employee Development: Do You Already Have All the Tools You Need? – Jon Pappas

When a direct report needs to improve their performance, managers sometimes think they need a comprehensive training program, with books and other resources. Development is not in books. Development is not activity—it’s a process. This presenter has used the following tools successfully in situations when he was the one-man training department, with no training budget:

1-on-1’s

Post-Project Lessons Learned

Stop/Start/Continue

Fridays5s

Feedforward

In this fun, interactive session, you’ll learn and take away no-cost practical tools and processes for developing employees and managers.

Workplace Bullying: The Evolving Dangers of the “Equal Opportunity Harasser” - Gregory J. Walsh, Esq.

Courts have held that employment law is “not intended to act as general civility code for the American workplace.” Most employers recognize, however, that employees feel it is their employer’s responsibility to protect against disrespect in the workplace, regardless of the underlying motivation. This topical presentation will reconcile an employer’s legal obligations with employee expectations by discussing trends in case law, proposed legislation and common fact scenarios that transform bad conduct to actionable conduct. Participants will leave with tools for identifying and addressing problematic workplace behavior before it is too late.

Presenters:

Stephen Hirschfeld, Esq., is a founding partner in the San Francisco office of Curiale Hirschfeld Kraemer, LLP. He has been practicing labor and employment law on behalf of management for nearly thirty years. He also serves as CEO of the Employment Law Alliance, the world’s largest network of labor and employment lawyers. Human Resource Executive magazine recently named him one of America’s 100 most powerful employment lawyers.

Jon Pappas has 13 years experience in the field of organization development and corporate training. Currently Jon is leading IT Training & Change Management at JDS Uniphase (JDSU). Prior to joining JDSU, Jon served as Manager of Training and Organization Development at Foster’s Wine Estates Americas, working with wineries such as Beringer, Chateau St. Jean, Stags’ Leap, and Meridian. Before joining Foster’s, he was the Training Manager for Advanced Fibre Communications (AFC), now Tellabs. Jon earned his Masters in Organization Development from Sonoma State University. He was adjunct faculty in the Organization Behavior program at the University of San Francisco and the Past President of the American Society for Training and Development North Bay Chapter.

BEST PRACTICES FOR HANDLING DIFFICULT EMPLOYEES

Approved for 1.5 CEC
Exchange Bank 545 Fourth Street (across the street from their old office!)
November 17, 2011
8:00 am – 9:30 am

Of the many hats worn by Human Resources, one of the most important is managing problem employees in a way that is fair, meets business needs, and minimizes risk to the company. In today’s environment, with continuing economic problems, budgetary constraints, poor morale, and greater awareness of employee rights, that role is all the more challenging. This program will look at what does and doesn’t work in dealing with these employees, including appropriate policies and procedures, maintaining at-will employment, avoiding legal landmines, preparing documentation, working with your supervisors and managers, and when all else fails, carrying out terminations.

About our Speaker

Carla Hartley is a partner with the law firm of Dillingham & Murphy, LLP in San Francisco. She specializes in employment law and has extensive experience in discrimination, harassment, retaliation, whistle-blowers, disability, and leaves of absence, reductions in force, contracts, wage and hour, intellectual property, and privacy issues. She has successfully tried cases and also provides a full range of non-litigation services such as advice and counseling. Ms. Hartley is a frequent speaker to business, human resource and EEO organizations and past chair of the Employment and Labor Practice Group for the USLAW Network, a national organization. She received her B.A. from the University of California at Berkeley and J.D. from Santa Clara University School of Law.
